SlumberPal Sleep Clock

Terms of Service

Version 1.0 · Effective

These terms are the agreement between you and SlumberPal for using the SlumberPal app and its connected services. Please read them with our Privacy Notice.

1. Who we are

These terms are between you and Slumber Pal Ltd, trading as SlumberPal, a company registered in Northern Ireland with company number NI744994, whose registered office is at 1 Lyndhurst Road, Londonderry, BT47 5HS, United Kingdom (“SlumberPal”, “we”, “us”). You can reach us at support@slumberpal.app.

The SlumberPal app, with its Parent mode and its Pal Screen mode, and our connected services together are the “Service”. Parent mode is for adults: parents, guardians and other carers the family allows in. Pal Screen mode is the restricted display a child sees.

2. Accepting these terms

You accept these terms when you tick “I agree to the SlumberPal Terms of Service” in the app before you set up a family. We record which version you agreed to and when. By agreeing, you confirm that you are an adult who can make this agreement where you live, and that you are the child’s parent or guardian or another adult allowed to act for the family you set up.

SlumberPal is offered in the United Kingdom and other countries where the App Store or Google Play lists it, except the United States. You must not use the Service from the United States.

3. What SlumberPal is, and is not

SlumberPal lets you set up a calm sleep clock for a young child: a pal, a night and morning scene, bedtimes, naps and wake-up times, sounds, activities and a morning present.

SlumberPal is not a baby monitor, an alarm, a medical or sleep-treatment service, or a substitute for looking after your child. Do not rely on it to wake, supervise or keep a child safe. A Screen can be offline, out of battery, switched off or have the wrong time, and then it may not show what you set. A change you send counts as done only when the Screen reports that it applied it.

Pal Screen mode keeps purchases, settings and links away from a child, but it is not a lock on the device. Use your device’s own controls, such as Guided Access on iPad or screen pinning on Android, if you want the child to stay in the app.

4. Your account and family

Each adult needs their own account and must keep their sign-in, parent PIN and devices secure. Tell us straight away at support@slumberpal.app if you think someone has used your account or a Screen without permission.

A family has an Owner and can add Parents and Carers, each with the permissions the app shows. The Owner manages the plan and can close the family. You may only add children you are responsible for, and only add adults you trust to look after them.

You need a compatible phone or tablet and an internet connection for setup and changes. Data charges from your network are yours.

5. Free, Plus and purchases

SlumberPal’s free features are free. Plus adds more pals, activities and sounds, as described in the app and on our Pricing page. Each new family gets 14 days of Plus in the app with no card and nothing that renews.

Paying. All purchases are made by an adult in Parent mode through the App Store or Google Play, which take the payment. The price, currency, tax and billing period you pay are the ones the store shows before you confirm. Pal Screen mode has no prices and no way to buy.

Subscriptions. Plus monthly and Plus yearly renew automatically at the end of each period until you cancel in the store account that bought them. Cancelling stops the next renewal; you keep Plus until the end of the period you paid for. Deleting the app, your SlumberPal account or your family does not cancel a subscription. Cancel on iPhone or iPad in Settings, your name, Subscriptions; on Android in Google Play, Payments and subscriptions, Subscriptions.

Lifetime. Plus Lifetime is a single payment that gives your family Plus for as long as we run the Service. It does not renew.

Stock pals and other one-off items are yours to use in the family you bought them for for as long as your account stays open and we run the Service, unless the purchase is refunded. They cannot be moved to another family.

When Plus ends, your family keeps the free features and your settings. A pal that came with Plus goes back to a free pal after the next wake-up unless you bought it.

Custom pals. Custom pals made from photos of a child’s own toy are not open to the public yet. If we invite your family to try them, the app will show the extra conditions that apply, including when your right to cancel ends, before you buy.

6. Cancelling and refunds

If you are a consumer in the UK or the EU, you normally have 14 days to cancel a contract made at a distance. For digital content and services that start straight away, you agree when you buy that we may begin at once, and you accept that your right to cancel ends once the content is supplied. This does not affect your other legal rights, including your rights if something you bought is faulty or not as described.

Refunds for App Store purchases are requested from Apple at reportaproblem.apple.com. Refunds for Google Play purchases are requested in Google Play, and we can also help at support@slumberpal.app. The store makes the final decision on refunds it handles. A refund removes the item or the Plus time it paid for.

7. Using SlumberPal fairly

You must not: interfere with the Service or its security; try to reach another family or child’s information; copy or reverse engineer the app except where the law allows it; use the Service to harm or exploit a child; upload anything unlawful or anything you have no right to upload; share your account outside your family; or create accounts, purchases or requests with automated tools.

We may suspend or limit an account where there is a real security, safety, legal or payment risk. Where we can, we will tell you why and how to contact us. We will still handle your deletion, refund and privacy requests.

8. Our content

SlumberPal’s software, pals, artwork, sounds, stories and other content belong to us or the people who licensed them to us. We give you a personal, non-transferable right to use them through the Service for your family. You may not copy, sell or publish them.

9. Changes and ending the Service

We update the Service to fix problems, keep it secure, follow the law and improve it. If a change materially reduces something you have paid for, we will tell you in advance and, where the law requires, offer you a remedy.

If we change these terms in a way that matters, we will ask you to agree again in the app before you add anything new. Until then you can still see, export and delete what you have saved.

You can stop using SlumberPal at any time and delete your family or account in Parent mode. We may end this agreement if you seriously break these terms, if the law requires it, or if we stop running the Service, in which case we will give you reasonable notice and explain what happens to anything you have paid for.

10. Our responsibility to you

We provide the Service with reasonable care and skill. We cannot promise it will always be available or free of faults.

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable, for business losses (the Service is for personal family use), or for problems caused by devices, networks or events outside our reasonable control.

Nothing in these terms limits our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breach of your legal rights as a consumer.

11. The law that applies

These terms are governed by the law of Northern Ireland, and the courts of Northern Ireland can hear any dispute. If you live elsewhere in the United Kingdom, you can also bring a claim in your local courts. If you live outside the United Kingdom, you keep the protection of the mandatory consumer laws of the country where you live, and you can bring a claim in the courts there.

12. Contact and complaints

For help or to complain, email support@slumberpal.app. We aim to reply within 2 working days.

If you believe something in SlumberPal uses your work or trade mark without permission, email rights@slumberpal.app with your contact details, the work or mark concerned, where it appears in SlumberPal and why you believe it infringes your rights.

For privacy requests, email privacy@slumberpal.app.

If we cannot resolve a complaint, you may be able to use an alternative dispute resolution service or your local consumer advice service, such as Citizens Advice in the UK.
